Eligibility
You must be at least 18 years of age (19 in Alabama and Nebraska), a legal resident of the United States, and possess a valid Social Security number to apply for any Advance America product. Some products carry additional state-specific eligibility requirements disclosed at application time.

Application & underwriting
All applications are subject to underwriting review. Submission of an application does not constitute an offer of credit. Approved offers are valid for 30 days from issuance and are conditioned on your representations remaining accurate and complete through closing.

Rates, fees & disclosures
Rates depend on credit profile, product type, loan amount, and term. Full APR, finance charge, payment schedule, and total-of-payments disclosures are provided on page one of every offer in compliance with the Truth in Lending Act. No origination fees, no application fees, no prepayment penalties.

Repayment obligations
You agree to repay all funded loans according to the schedule provided at closing. Automated ACH withdrawal is the default; alternate arrangements can be made through customer service. Missed payments accrue interest per the loan agreement and are reported to the major credit bureaus after 30 days delinquent.

Electronic communications
You consent to receive account communications — statements, disclosures, tax forms — electronically at the email address on file. Paper copies are available on request at no charge.

Fair lending
Advance America underwrites without regard to race, color, religion, national origin, sex, marital status, age, or the fact that all or part of the applicant's income derives from a public assistance program, in accordance with the Equal Credit Opportunity Act.

Prohibited use
You may not use Advance America products to fund illegal activity, gambling, or securities-margin activity. Business loans are for legitimate business purposes only and are not consumer credit under Regulation Z.

Dispute resolution
Any dispute arising under these terms is subject to binding individual arbitration under AAA Consumer Rules, with an opt-out available within 30 days of account opening. You retain the right to bring claims in small-claims court and to file complaints with the CFPB.

Limitation of liability
Advance America is not liable for indirect, incidental, or consequential damages. Direct liability under these terms is capped at the total fees paid on the specific product giving rise to the claim.

Modification of terms
Material changes to these terms are communicated at least 30 days in advance. Continued use of Advance America products after the effective date constitutes acceptance.

These terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles, and by applicable federal consumer-protection statutes.
